§1 General information

  1. The Internet Service https://eurocert.pl/ is operated by EuroCert Spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw (02-844), at 474 Puławska Street, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000408592, NIP: 9512352379, REGON: 145930258.
  2. The administrator of the Personal Data collected through the https://eurocert.pl/ website is EuroCert Spółka z ograniczoną odpowiedzialnością, based in Warsaw.
  3. Personal Data is collected through this Service in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU. L. of 2016, No. 119, p. 1), hereinafter referred to as “GDPR”, the Personal Data Protection Act of 10 May 2018. (Journal of Laws 2019, item 1781) and the Act on Providing Electronic Services of July 18, 2002. (Journal of Laws 2013, item 1422).
  4. The Administrator shall make every effort to provide the stored data with an appropriate degree of security.
  5. The Service processes only the personal data of Users who have provided them voluntarily in accordance with the purpose of their use indicated by the Service when filling out the relevant forms on the Service.
  6. The Administrator processes your personal data for the purpose of:

    a) the performance of a service/order, i.e. on the basis of Article 6(1)(b) of the RODO in accordance with which processing is necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract. Personal data will be processed for the period of execution of the order/service and for the time necessary after its/their completion;
    b) fulfillment of the complaint process on the basis of Article 6(1)(c) of the RODO, according to which the processing is necessary for the fulfillment of a legal obligation incumbent on the controller. Personal data will be processed for the period of fulfillment of the legal obligation and possible further period of use of the services offered by the Administrator;
    c) asserting our claims on the basis of Article 6(1)(f) of the RODO, i.e. the Administrator’s legitimate interest in asserting our claims and defending our rights, and Article 9(2)(f) of the RODO, i.e. the processing is necessary for the assertion of claims. Personal data will be processed for the period of claim investigation;
    d) to fulfill tax obligations on the basis of Article 6(1)(c) of the RODO (processing is necessary to fulfill a legal obligation incumbent on the administrator) in conjunction with Article 74(2) of the Accounting Act. Personal data will be processed for the period necessary to fulfill the tax obligation. We process all data processed for accounting purposes and for tax reasons for 5 years calculated from the end of the calendar year in which the tax obligation arose;
    e) if consent is obtained – for marketing purposes on the basis of Article 6(1)(a) of the RODO (the data subject has consented to the processing of his/her personal data for one or more specified purposes. The data will be processed for the duration of the marketing action or until the consent is withdrawn;
    f) to realize the legitimate interests of the Administrator (based on Article 6(1)(f) of the RODO): marketing of the Administrator’s own products or services, direct marketing, directing all communications related to the Administrator’s services, including new products, services or functionalities; in this case, the data will be processed until the data subject objects.

  7. The Administrator processes personal data of visitors to its profiles maintained on social media (Facebook). Personal data is processed in connection with running such a profile in order to promote the Administrator’s services, Administrator’s Partners, inform about events, promotions, actions organized by the Administrator or cooperating entities. Personal data is processed on the basis of Article 6(1)(f) of the RODO, i.e. the legitimate interest of the Administrator.
  8. In order to use our services, you must expressly consent to the processing of your personal data by pressing the checkbox with the consent clause for the processing of personal data.
  9. If the user does not consent to the processing of his/her personal data through the registration form with or without creating an account, the Service will not be able to process the user’s order.

§2 User rights

  1. Right to withdraw consentWhere we process your data on the basis of consent, you have the right to withdraw it at any time. You will be informed of this each time. Please be advised that withdrawal of consent will not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal.You may at any time withdraw the consent you have previously given for the processing of your personal data by sending your withdrawal by e-mail to the following e-mail address: biuro@eurocert.pl and by post to: EuroCert Sp. z o.o., 02-884 Warsaw, 474 Pulawska Street.

Right to portabilityIf your personal data is processed on the basis of consent, a contract concluded with you, or by automated means, you have the right to request a copy of that data in a structured, commonly used and readable format. This applies only to data provided to us. You have the right to request that a copy of your data be sent to another entity.
  1. Right to rectification of dataWe have the right to process only correct and up-to-date personal data. We must delete or rectify incorrect and outdated data. You have the right to request rectification of your personal data if it is incorrect, and to complete incomplete data.  If you have an account on the site you can edit your personal data provided on the site at any time.
  1. Right to erasureYou may at any time request the deletion of your personal data processed by us. However, deletion of your personal data will not be possible if:

    a) you have not paid your financial obligations to the Administrator,
    b) you have an open order that has not yet been completed or has only been partially completed,
    c) we are bound by a contract with you,
    d) the law dictates that we keep your personal data for a certain period of time,
    e) if you use our services, we will retain your personal transaction data for accounting purposes.

  2. Right to erasureYou may at any time request the deletion of your personal data processed by us. However, deletion of your personal data will not be possible if:You have the right to request restriction of the processing of your personal data if:

    a) you question the accuracy of the personal data we process – we will restrict processing until the accuracy of the data is verified,
    b) the processing is unlawful – in this case we will restrict the processing of your personal data at your request in case you object to the deletion of your personal data,
    c) we no longer need your personal data for the purposes of processing, but you need them to establish, assert or defend claims,
    d) you raise an objection to the processing – we will restrict the processing until we determine whether the legitimate grounds on our side override your objection.

  3. Right to object to processingYou have the right to object at any time to the processing of your personal data on grounds relating to your particular situation. You have this right when we process your data for purposes arising from legitimate interests pursued by us or by a third party, or when the processing is necessary for the performance of a task carried out in the public interest.You may object at any time to our processing of your personal data for direct marketing purposes, including profiling. If you file an objection, we will not process your personal data for direct marketing purposes from that point on. You also have the right to withdraw your consent to direct marketing at any time.

Complaint to the supervisory authorityIf you consider that we process your personal data in violation of the law, including in particular the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU. L. 2016 No. 119, p. 1), you have the right to make a complaint to the supervisory authority.

§3 Contact form

  1. The Service will process personal data when the User fills out the contact form on the website at https://eurocert.pl/.
  2. The collected data will be processed only for the purpose related to the provisions of the form.
  3. When filling out the form, the User shall provide in the form only the necessary data to process the order:

    a) first and last name,
    b) address,
    c) telephone no,
    d) e-mail address,
    e) company name,
    f) tax identification number.

  4. The Seller may also process the following data characterizing the User’s use of the Website (exploitation data):

    a) identification markings of the User assigned on the basis of the data referred to in item. 3 of this paragraph;
    b) designations identifying the telecommunications network termination or data communications system used by the User;
    c) information about the beginning, end and scope of each time the User uses the Service;
    d) information about the User’s use of the Service.

  5. The User filling in the form may optionally consent to receive newsletter-type messages from EuroCert Sp. z o.o.
  6. (Consent to receive newsletter-type messages in accordance with Section 5 is entirely voluntary and may be revoked at any time by submitting one’s resignation in accordance with § 2 (1).

§4 Recipients of data

  1. Personal Data shall be made available to other entities to the extent necessary for the performance of the Sales Agreement, i.e.:

    a) EuroCert Authorized Partners listed on the website – https://sklep.eurocert.pl/pl/i/Punkty-Sprzedazy/14;
    b) Shoper Platform (DreamCommerce S.A.) with its registered office in Kraków (31-280), 79 Władysława Łokietka Street, NIP: 9452156998;
    c) PayPro S.A. – based in Poznań at Kanclerska 15 Street (60-327 Poznań), NIP: 7792369887;
    d) entities acting on behalf of the Administrator, subcontractors cooperating with us on the basis of agreements concluded for the entrustment of personal data processing, suppliers of ICT services and solutions, IT systems, entities acting as intermediaries in the sale of our services or organization of our marketing campaigns (including newsletter mailing), consulting entities, auditors, law firms, accountants, courier companies, entities engaged in payment activities (banks, financial institutions), providers of debt collection services, third-party providers of identity identification services, companies engaged in the protection of persons and property, entities or authorities authorized by law (including courts, prosecutor’s office, police).

  2. In addition, personal data may be transferred to state authorities or entities performing public tasks in connection with the proceedings conducted by these authorities and on the basis of the law.
  3. We store personal data only in the European Economic Area (“EEA”).

§5 Cookies Policy

Cookies files – known as “cookies”, are IT data, in particular text files which are stored on the Service User’s terminal equipment and are intended for use on the Website. Cookies usually contain the name of the website they come from, the time they are stored on the end device and a unique number.

The Service uses cookies.

When a User visits the Website, the system sends at least one cookie file to the User’s computer in order to uniquely identify the browser. The server automatically logs the information sent by the User’s browser when viewing the sites. Server logs may include information such as network request, IP address, browser type and language, date and time the request was sent. This information allows us to improve the quality of our service by identifying and storing User preferences and tracking trends, such as the ways in which our site is searched.

In connection with the above, the Website draws the Users’ attention to the fact that using the Website’s services may involve a risk related to interference by third parties in the transmission of data sent via the Internet between the Website and the User.

We reserve the right to amend this Privacy Policy by publishing a new Privacy Policy or updating individual provisions of the Policy on this website.
